Terms and Conditions
The PES contract was awarded under FAR Part 12, “Acquisition of Commercial Items”. The FAR clauses (FAR 52.212-4) apply to the PES contract and are provided in the PES Price List Catalog. Ordering agencies may include provisions in individual task orders that are essential to their requirements (e.g., security clearances, hazardous substances, special handling, key personnel, etc.). The PES Contract allows additional clauses, terms, and conditions to be included provided they do not conflict with the terms and conditions of the PES contract.
